Genedata is an international company that provides software solutions and related services to companies for their research and development needs. This Privacy Statement applies to certain Genedata services set forth below, including this website, event registrations, responding inquires, etc. (“Services”).

This Privacy Statement describes what personal information and the purposes for which it is collected and processed by Genedata and its affiliated companies (“Genedata”, “we”, “us” and “our”) in connection with our Services.

Who is the Data Controller?

Genedata AG shall be considered as the data controller for the processing of the personal information for the website on which you consulted this Privacy Statement, or which referenced this Privacy Statement, unless the context provides otherwise. We may also act as joint controllers with our affiliated companies namely with regards to the processing of the personal information by the Genedata legal entity with which you communicate or contract with.

In the event that the processing of your personal information is covered by the EU General Data Protection Regulation 2016/679 (GDPR), the EU representative of Genedata AG is Genedata GmbH. You can contact the data privacy officer of Genedata GmbH by sending an email to privacy(at)genedata.com.  

Please note that this Privacy Statement does not apply to the processing of personal information on behalf of our customers. In this case, our customers will typically act as data controllers for any Personal Information related to the personal information shared with Genedata for provision of licenses and services, and Genedata (and, where applicable, its affiliated companies) will typically act as the data processor in accordance with applicable data processing agreements.

What is Personal Information and What Personal Information Do We Process?

Personal information, or personal data, is any information that can be used to directly or indirectly identify an individual, and may include, for example, name, address, email address, phone number, work title, login information (account number, password), or social media account information.

The information we collect depends on the interactions you have with Genedata, the context, and the purposes for which it was collected.

We may collect information that can be used to identify you, such as your name, contact information (i.e., information that normally would be in a business card, for example, your business email address, business title and company name) or other personal identifiers. Personal information is collected directly from you, for example, when you register on our website by filling in a contact form for an event, when you fill in a Demo Request form, when you request information from us via email, when you participate at our conferences, symposiums, seminars or other events, or when you participate in one of our surveys, or even when you apply for a job via our website.

In addition, Genedata collects technical information directly and/or automatically, for instance through the use of cookies, which can include information related to your browsing pattern on our website, click stream, and the status of cookies placed on your computer.

Cookies are small files, composed of a string of letters and numbers, stored on your computer. You can choose to accept or decline the cookies. We do not knowingly collect any personal information of children under the age of 16.

How and Why is Your Personal Information Processed?

Genedata may process your information in order to provide you with certain services, including:

  • Process your registration to participate in conferences, symposiums, seminars and other events;
  • Respond to your enquiries, for example, to fulfill your request for a demo, to provide you with access to one of our whitepapers or to provide you with information you have requested about our services;
  • Respond to your requests for feedback;
  • Send you survey emails (please note that you can always opt-out of receiving such surveys at any time by contacting us);
  • Administer our website, including troubleshooting, data analysis, testing, statistical and survey purposes but also as part of our efforts to keep our website secure;
  • Provide you information on our products and services that you have specifically requested;
  • Market our products and services to the company you represent;
  • Perform auditing and statistical analyses of user behavior in order to measure interests in specific product areas or information posted on our website, with a specific focus on improving our products and services; and
  • Process/manage job applications and communicate with applicants.

On What Grounds Do We Process Your Personal Information?

Pursuant to the GDPR, the UK General Data Protection Regulation (UK GDPR), or other applicable law, if any, the processing of your personal information must have a legal basis. Thus, we may process your personal information for the purposes described in this Privacy Statement with your consent, for the fulfilment of a contract, for compliance with a legal obligation or when necessary, or for the purposes of a legitimate interests pursued by Genedata.

Certain processing of your personal information is based on your consent (e.g., when you send us a request through our Contact form, request a demo, sign up to participate in one of our events or conferences, or provide us with your business card). In such cases, you have the option to withdraw your consent at any time, either by opting out in the link provided in our contact email, or by contacting us directly at: privacy(at)genedata.com. A revoked consent has no effect on any data processing that already has been carried out.

Genedata may process your personal information if a contractual relationship exists. In this case, the data processing takes place in order to fulfill the contractual obligations.

The use of your personal information may be based on our legitimate interest to ensure content availability, information security and business performance improvement. We may also process your personal information in order to pursue our legitimate business purpose to keep you informed of our latest products and services.

Genedata may also use your personal information to comply with legal obligations to which we may be subject, including applicable laws and regulations, as well as demands or requests made by regulators, courts and law enforcement authorities.  

When and How Do We Share and Transfer Your Personal Information?

Genedata may share your personal information with its affiliated companies located in Germany, the UK, Japan, Singapore, or the US for the same purposes of processing as the ones applicable to Genedata.

Additionally, Genedata may share your personal information with third parties that provide technology services such as data analytics, storage, hosting and technical support; our professional advisors, auditors and business partners, regulators, government or law enforcement authorities; other third parties in connection with re-organizing all or any part of our business; or governmental agencies or third parties in order to comply with applicable law, legal process, or any other legal obligations. Genedata does not sell personal information to anyone.

For transfers of personal information that is subject to the GDPR, the Swiss Federal Data Protection Act (FDPA) or the UK GDPR to a third country outside the European Union (EU), European Economic Area (EEA) or in absence of an adequacy decision, within Genedata and its affiliated companies, to the Genedata business partners and service providers, we establish the contracts containing the EU Standard Contractual Clauses, which according to the EU Commission decision of 04 June 2021 (EU 2021/914) constitute appropriate and suitable safeguards to ensure compliance with GDPR, that are supplemented by the requirements of the UK GDPR and the FDPA, accordingly.

Profiling And Automated Decision-Making

Your personal information is not subject to any automated decision-making. We do not conduct profiling activities with personal data.

What Are Your Rights regarding Your Personal Information?

If the processing of your personal information is subject to the GDPR, the UK GDPR and/or the Swiss Data Protection Act, you may be entitled to exercise certain rights in relation to your personal information that is processed by Genedata, subject to certain limitations provided by the applicable data protection law. The rights conferred to you may be exercised at any time and may include: 

  • The right to request access to your personal information;
  • The right to request to correct any personal information that is held by us which is inaccurate or requires updating; 
  • The right to request deletion of your personal information that is held by us; 
  • The right to request that we stop processing your personal information other than for storage or legal purposes;  
  • The right to request a subset of the personal information we collect from you in a structured, commonly used and machine-readable format—including a right to request that we transfer such personal information to another party (right to data portability); 

In addition to the above rights, and if the processing of your personal information is subject to the GDPR, you may also have the right to request withdrawal of your consent to process your personal information that you previously provided Genedata with.

Genedata will, within the timeframe set out by the applicable law, examine your request and respond to it or contact you to ask for further information or clarification. You may submit your request by sending an email to privacy(at)genedata.com in which you must explain your request and the right that you wish to exercise. In order to avoid delays in responding to you, we encourage you to formulate your request as detailed and as specific as possible and provide us with evidence of your identity (e.g., with a copy of an ID card, if your identity cannot be otherwise clearly verified).

We reserve the right to enforce the restrictions required by law in cases where we are obliged to store or process certain data or have an overriding legitimate ground to do so.

How Long Do We Store Your Personal Information?

We may store your personal information for different periods of time depending on the category of personal information and the purpose for which it’s being processed. In any case, we will always keep your personal information in accordance with and not exceeding the duration determined by applicable law and otherwise, for as long as needed to provide you with access to the services and/or products requested by the company you represent; or for as long as necessary to allow us to respond to your question or request, or to fulfil our contractual and legal obligations or for the purpose pursued by the processing. 

The retention periods may be determined by the following criteria: (i) the duration of the ongoing relationship with you and provide the website to you; (ii) whether there is a legal obligation to which we are subject; or (iii) whether retention is advisable in light of our legal position (such as in regard to the enforcement of the applicable statutes of limitations, litigation or regulatory investigations).

Links to Third Party Websites

We may provide, from time to time, links to third party websites as a service to our users. Please be aware that we cannot control and are not responsible for the information collection practices of such third-party websites, which may differ from those on our website. We encourage you to review and understand the privacy policies of these websites before providing any information to them.  

Security measures

Genedata has implemented appropriate technical, organizational and administrative measures and generally accepted standards of technology and operational security in order to protect personal information from loss, misuse, alteration, destruction and unauthorized access.

However, no such measure is 100% effective, therefore we cannot guarantee complete security from theft, loss, or unauthorized access or use, of your personal information. Unauthorized entry or use, hardware or software failure, and other factors triggered by malicious persons or acts of negligence may compromise the security of your personal information.

Additional Disclosures for California Consumers

If you are a California resident, this section provides further disclosures applicable to information that Genedata may collect, use, and share about you under the California Consumer Privacy Act of 2018, as amended (“CCPA”).

Residents of California benefit from have the following rights:  

  • Right to know about your personal information that is collected, how it is used, and shared, which parties it is shared with, and why it is collected;
  • Right to correct and delete your personal information;
  • Right to opt out of the sale or sharing of your personal information;
  • Right to limit use and disclosure of sensitive personal information; and
  • Right not be discriminated against for exercising your California privacy rights.

Notice at Collection under CCPA

While Genedata does not sell any personal information, Genedata may need to share your personal information with its affiliates and third parties pursuant to a business purpose as further described in Section “How and Why is Your Personal Information Processed?” above in this Privacy Statement.  

The list below includes categories of personal information we will collect and disclose, and have collected and disclosed in the preceding twelve (12) months:

  • Identifiers, such as, name, address (country), email address, phone number, work title may be collected when you register for Genedata events on this site’s events page.
  • Commercial Information, such as the events you sign up for on this site’s events page.
  • Website Activity, such as information regarding your interaction with this website, and information obtained through cookies (see Cookie Notice).
  • Professional or employment-related information, such as your professional title, company name, and company email, and contained in your resume or job application that you submit to Genedata (e.g. professional certifications/licenses, or employment history).
  • Education Information, submitted to us in your resume or job applications to Genedata.

Your personal information will be retained for a period of time based on the category of personal information, the purpose for which it is retained, and any applicable legal obligations to which we are subject. Please see above Section “How Long Do We Store Your Personal Information?” above for further details.

In order to fulfill your request, Genedata may need to verify your identity, authorization and/or ask for additional information.
